LIMITED WARRANTY

Electrosa Security & Networking Systems (ESNS from now on) will repair and, if necessary, replace, without charge, any merchandise proved defective in material or workmanship under normal use and service for the period of one (1) years from the date of the invoice of the product. The repaired or replaced product is then warranted under the terms of the limited warranty for the balance of the term of the warranty. The exception to this limited warranty is the hard disk failure on Digital Video Recorder which shall follow the limited warranty of the hard disk's manufacturer.

All goods requiring warranty repair shall be sent freight prepaid to ESNS, 3240 Lenworth Dr. Mississauga, ON  L4X 2G1 CANADA. Repairs made necessary by reason of misuse, alteration, normal wear, accident, or natural disaster are not covered under this warranty.

ESNS assumes no risk and shall be subject to no liability for damages or loss resulting from the specific use or application made of the Products. ESNS's liability for any claim, whether based on breach of contract, negligence, infringement of any rights of any party or product liability, relating to the Products shall not exceed the price paid by the Dealer to ESNS for such Products. In no event will ESNS be liable for any special, incidental or consequential damages (including loss of use, loss of profit and claims of third parties) however caused, whether by the negligence of ESNS or otherwise.

CREDIT RETURN

ESNS will credit new, standard product items that are unused and in original shipping carton for a period of 30 days from the original shipping date. All merchandise returned for credit may be subject to a 20% restocking and refurbishing charge. Credit must be used within one (1) year of the date of issue.

RETURNS

A Return Material Authorization (RMA) number is required for all product returns including credit returns, advance replacements, warranty repairs and non-warranty repairs. The RMA number can be obtained by phone, fax or e-mail. Please have the following information ready when contacting ESNS for RMA number: 1. Model and serial number 2. Date of shipment, P.O. number and ESNS invoice number 3. Details of the defect.[or problem] Method of return shipment shall be the same or equal to the method by which the item was received from ESNS (Include all the parts, accessories and manuals that came with the product). Any scratches, dents and/or stains on any part will not be repaired. However, at buyer's option, ESNS will replace scratched, dented or stained parts with brand new parts at buyer's cost. After the product has been packaged appropriately, place the RMA number on the outside of the package enclosing a written explanation setting force the potential defect in reasonable detail.. All products must be returned freight prepaid within 30 days of obtaining the RMA number. Freight collect returns or unauthorized returns will not be accepted and will be returned to sender upon receipt at buyer's expense. All returns and repairs are subject to ESNS's evaluation upon receipt. ADVANCE REPLACEMENT

ESNS will advance replace defective equipment that has failed upon initial install (bad-out-of-box) with new or like new product for a period of 30 days from the original date of shipment. All replacements will be invoiced at shipment and credited upon receipt of the defective product. Invoices will remain outstanding if the returned product does not qualify for replacement.

NON-WARRANTY REPAIR

Buyer will be charged on all repairs and shipping costs for out of warranty products. Charges may vary based on the actual product and condition. Repair charges may be based on parts and labor.

DISCLAIMER OF WARRANTY

EXCEPT FOR THE FOREGOING WARRANTIES, ESNS HEREBY DISCLAIMS ND EXCLUDES ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO ANY AND/OR ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR ANY WARRANTIES WITH REGARD TO ANY CLAIM OF INFRINGEMENT THAT MAY BE PROVIDED IN THE UNIFORM COMMERCIAL CODE AND/OR IN ANY OTHER COMPARABLE STATE STATUTE. ESNS DISCLAIMS ANY REPRESENTATIONS OR WARRANTY THAT THE PRODUCT IS COMPATIBLE WITH ANY COMBINATION OF NON-ESNS PRODUCTS PURCHASER MAY CHOOSE TO CONNECT TO THE PRODUCT.

LIMITATION ON LIABILITY

THE LIABILITY OF ESNS, IF ANY, AND PURCHASER'S SOLE AND EXCLUSIVE REMEDY FOR DAMAGES FOR ANY CLAIM OF ANY KIND WHATSOEVER, REGARDLESS OF THE LEGAL THEORY AND WHETHER ARISING IN TORT OR CONTRACT, SHALL NOT BE GREATER THAN THE ACTUAL PURCHASE PRICE OF THE PRODUCT WITH RESPECT TO WHICH SUCH CLAIM IS MADE. IN NO EVENT SHALL ESNS BE LIABLE TO PURCHASER FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR LABOR COSTS OF ANY KIND INCLUDING, BUT NOT LIMITED TO, COMPENSATION, REIMBURSEMENT OR DAMAGES ON ACCOUNT OF THE LOSS OF PRESENT OR PROSPECTIVE PROFITS OR FOR ANY OTHER REASON WHATSOEVER.
